Pendergrass is a proud graduate of Chapel Hill High School, where he played baseball for the Tigers on some of their best teams. After high school, Hathaway entered UNC-CH, and he graduated in 2006 with a B.S. in Business Administration from the Kenan-Flagler Business program. He was a member of The National Society of Collegiate Scholars and the Chi Phi fraternity.

Pendergrass worked in finance in Atlanta with Prudential Mortgage Capital Company for two years.

Pendergrass entered North Carolina Central School of Law in 2009 and quickly rose to the top of his class. He graduated in 2012 Summa Cum Laude and number 5 in his class. He served as Editor-in-Chief of the North Carolina Central Law Review, was awarded the American Law Institute and American Bar Association Scholarship and Leadership Award, and earned a Full Tuition Scholarship for his second and third years. Hathaway then passed the North Carolina Bar in the Fall of 2012.

Pendergrass augmented his legal education with valuable internships with Superior Court Judge Allen Baddour; with the District Attorneys' offices in both Orange and Wake Counties; with the Attorney General's office in Raleigh; and with Baddour, Parker & Hine, Attorneys, in Goldsboro.

Pendergrass is President of the Orange County Rape Crisis Center Board of Directors, President of the 15B Judicial District Bar, and volunteers as a Teen Court Judge with Volunteers for Youth in Orange County. Pendergrass previously served on the Carrboro Planning board, volunteered as the attorney for the Carrboro Farmers' Market, and served as a volunteer in the 15B Judicial District Guardian Ad Litem program. He also enjoys running and officiating youth baseball and basketball.

Pendergrass lives in Hillsborough, with his wife Kate LaVange Pendergrass, who teaches mathematics at Carolina Friends School, their daughter Eliza, and their dog Desmond.
